Studios. Valid sources? Logos vs text?

A while ago my contribution was accepted in which, among other things, I switched the order of the first two studios. The DVD is SAW II (Netherlands) UPC 5050582425741. Very recently  another contribution to the same UPC was made in which this change was reversed, this was also accepted.

(Another change was also reversed, thanks for that Giga! , I still can’t figure out what I was doing when I made that change and I’m glad you caught it!    )

Anyway…

Onscreen:
Starting up the dvd you first see the Universal Pictures logo (the DVD distributor in NL). When you get to the menu, if you choose “Play film”, it starts with the Lions Gate Films logo, then the Twisted Pictures logo. When the film actually starts it starts with the text “Twisted Pictures presents” ...  “A Burg/Koules/Hoffman production". Lions Gate Films isn’t mentioned until the end credits (as copyright holder).

Offscreen:
The cover says A Lions Gate Films release Twisted Pictures Presents (and so on) and has Saw 2 Productions as copyrightholder.
My original change put Lions Gate Films in the first spot as the theatrical release studio  and Twisted Pictures as second (considering it to be the production company). (I also added Saw 2 Productions, stating that I took that from the cover.)

My reasons at the time for putting Lions Gate Films as theatrical release studio were: 1. first credited (as logo) when you start the film, 2. The cover says ”A Lions Gate Films release” and 3. Imdb lists Lions Gate Films as theatrical release studio and Twisted Pictures as production company, so does Wikipedia (http://en.wikipedia.org/wiki/Lions_Gate).

The approved reversal of my change is motivated as following: Twisted Pictures is the presenting production company (releasing) not the order of logo's count, textual credits count!

I can understand the distributor’s argument but it’s now left me a bit confused as to what the right way to do things is (for future contributions).     

Basically I’d like an answer to the following questions:
- Do we in fact ignore the logo’s if they’re different than the textual credits? (So far I haven’t found anything that explicitly states that we do.)
- What are valid ways to determine who the theatrical release studio is, and once determined, does that studio go in the first slot regardless of where (and if) they are credited?
- Does “ ABC presents” overrule “an XYZ –release”?
- Is it allowed to add a studio from the cover if the opening and end credits mention less than 3 studios? (Or should I not do that in the future?)

This has been discussed before and it the Creds we use not the logos.

Thanks for the fast partial answer.  (The question however, is a bit more broad than just that one bit.)

(BTW I'm all for using the text and ignoring the logo's, but I'd like something I can refer to in future contribution notes.)

I am going to disagree with Skip here, just a little bit, but only because it is Lionsgate we are talking about. 

Lionsgate likes to make things difficult for us as profilers as they don't always insert a written credit on films they distribute.  I don't know why that is, but it is what it is.  If you look at the credits for this film, there is a section for Lionsgate, that deals strictly with distribution and advertising for the film.  This tells me that they had nothing to do with the film, outside of distribution, so that might be the reason but I am not 100% on that.

That being said, there is no doubt that Lionsgate was the theatrical distributor...at least there shouldn't be because they are credited...in logo, credits, copyright and the case.  Now, my normal rule of thumb is as Skip noted: copy the studios from the written credits in the order credited.  But, as I said in another thread, there are exceptions to every rule.  This is one of them.

The rules tell us to enter the Theatrical Release studio first, in this case that is Lionsgate, so that is what I would do and have done in my local profile of this film.

I can vouch for this series, having seen each entry in the theater on opening day. All of them opened in theaters with the Lionsgate logo, then Twisted Pictures.
We can't always trust opening logos on dvds (thanks MGM), but I'd like to think we can in theaters.

Honsetly I can't recall what the first 3 films were, last 2 are definitly Lions Gate. Pretty sure the first 2 were Lionsgate.
Sorry about mis-spelling it in previous post, esp. when mis-spell = alternate studio credit.
Studios are getting as bad as Re-recording Mixers.
