Brazil was actually a bad example as while both DVDs are the same cut, neither is the R-rated version.

In the case of Criterion Collection titles (as well as Anchor Bay and Blue Underground), they usually publish the MPAA rating on the back of the case so when they choose not to, I figure it's for a good reason.  It seems to me (according to the rules) that these should be UNRATED because a rated version was previously available (but the new BD/DVD says NR or nothing at all).

Ace, in the case of The Man Who Fell to Earth, I pulled my contribution because I just don't know really what it should be rated (I've been updating profiles to UNRATED to match the new rules). Previous DVD releases (with the same running time 139 min) were rated R and the movie was rated R in 1976, but for some reason, Criterion did not include the rating on this release. This suggests to me that maybe a minor change was made for this release (it does often happen).

LOL, good reason...hmmm, Odball. Criterion "Fiend Without a Face" contains NO RATING of any sort and with good reason, it was released in 1958, long before there was ever ANY sort of ratings system in the United States. Image is not required to submit any movie to the MPAA, particularly the older ones, in Europe I understand it would HAVE to be submitted to some ratings board. So it has never been rated in the States, there is NO DATA, No Data is a null field. To say otherwise is inventing data. I never believe is creating data where no data exists in fact.

But I'm talking specifically about movies that were orginally rated by the MPAA for its USA theatrical release, but the BD/DVD does not include the rating (even though it appears to be the same cut). Should we use the original rating (even if it's not listed on the cover) or use UNRATED? Or NR (which is what we have been using before the rule change)? Seems to be a gray area.

Well oddball, in the instance you describe, assuming their is NO data on the package, that would be MY choice and the way I will handle it here. But the Rules do allow for filmratings.com to be used, I fear this will lead to misrepresentations, not intentionally on anyone's part, but that's what the Rules allow for. I just follow the data, amigo, if it's there fine, if it's not i won't make it up.

Skip... take a look at THIS POST Ken has said in that situation you can use filmratings.com only if you can document that it is the rated version on the disc.

How would we document this?

This is all I can think of:

-cite running times (from theatrical presentations and previous BD/DVD releases) (+/-1 minute)
-cite ratings from previous BD/DVD releases (that have matching running times)
-cite the fact that the packaging doesn't advertise anything new or different (about the cut included).

Criterion does list MPAA ratings on a lot, but also omit them on a lot, including at least half a dozen where I can't find any reason to believe there's an alternate cut.

If the ratings is not included, Ace, then you have to go by what pete said. idf that doesn't work then there is no rating at all.

Changed my vote to NR.

Just downloaded an update and I didn't like seeing Howards End (BD) listed as Unrated when I know it's the PG version. It's just wrong.

So glad, for once, at the UK rating system... Everything except a few educational exemptions must be rated by the BBFC and If rated by the BBFC but no rating on the cover = Illegal to sell.

You thought correctly.  If there is no rating on the case, and it doesn't meet the standards for 'Unrated', it is entered as 'NR'.
